You may want to ask your lender to produce the note if you are facing a foreclosure. You may be able to stave off foreclosure if your lender cannot produce the original mortgage documentation. A lender must be able to provide the original mortgage documentation to be able to proceed with a foreclosure in most states. If you are not getting anywhere with a loan mod with your lender this may be a great alternative.

Can Lawyers Do Loan Modifications?

Can a lawyer do a loan modification? I recently saw that Phillips and Associates is doing loan modifications. There are a law firm that advertises on tv alot for bankruptcy and dui. I was very surprised to see them in the loan mod business. The truth is that you can do a mortgage loan modification yourself. Your first call should be to your lender and ask about how the process works. You may need to talk with someone in the loss mitigation department. Theoretically there is not such thing as loan modifications in the banker world. A law firm like Phillips & Associates should only be hired if you really don't want to mess with it or you just are to scared to represent yourself.

My recomendation though is to try it yourself first before you hire an expensive loan modification company or loan modification attorney.
